These Terms of Service ("Terms") govern your access to and use of AllScanAI.com and the AllScan AI mobile application (collectively, the "Service"), operated by AllScan AI ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using AllScan AI in any capacity, whether through the website, mobile app, or API, you acknowledge that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AllScan AI provides AI-powered image scanning and identification. Users upload or capture photographs, and the Service analyzes those images using machine learning models to return identification results. The Service covers a wide range of categories including plants, animals, insects, birds, fish, mushrooms, coins, banknotes, rocks, antiques, food, products, and more. AllScan AI also offers reverse image search, product lookup, and camera-based translation features.

3. Free Tier and Rate Limits

AllScan AI provides a free tier of service subject to the following fair usage limits:

  • Web Scanner: One (1) free scan per day per device on AllScanAI.com.
  • Mobile App: A limited number of free scans per day as determined by the current app configuration. The specific daily allowance may change without notice.

Free scans reset on a rolling 24-hour basis. Attempts to circumvent rate limits through automated tools, multiple device emulators, VPN rotation, or other technical means constitute a violation of these Terms and may result in temporary or permanent access restrictions.

4. Subscription and Paid Features

AllScan AI offers an optional subscription through the iOS App Store and Google Play Store that provides unlimited daily scans and access to premium features. Subscription pricing, billing cycles, and renewal terms are displayed at the time of purchase and governed by the respective app store's policies.

Refund requests for subscriptions should be directed to Apple or Google, as they process all payments. AllScan AI does not directly handle subscription billing or have access to your payment information.

5. AI Results and Accuracy

AllScan AI uses machine learning models to generate identification results. While we strive for high accuracy, AI-generated results are not guaranteed to be correct. Results should be treated as informational guidance, not as definitive conclusions.

Specifically:

  • Do not rely solely on AllScan AI results to determine whether a plant or mushroom is safe to consume.
  • Do not use AllScan AI as a substitute for professional medical, veterinary, or scientific advice.
  • Coin, banknote, and antique valuations are estimates based on visual analysis and should not replace professional appraisal.
  • Food and nutritional information returned by the Service is approximate and should not be used as the sole basis for dietary or health decisions.

You are solely responsible for any actions or decisions you make based on AllScan AI results.

6. User Conduct

When using AllScan AI, you agree not to:

  • Upload images that contain illegal content, explicit material, or content that violates the rights of others.
  • Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated scripts, bots, or crawlers to access the Service beyond the intended user interface.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to it.

7. Intellectual Property

All content, design, code, AI models, branding, and technology that comprise AllScan AI are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain full ownership of any images you upload to the Service. By uploading an image, you grant us a limited, temporary license to process that image solely for the purpose of delivering an identification result. This license terminates the moment your image is deleted from our servers, which occurs immediately after processing.

The "AllScan AI" name, logo, and associated branding are our trademarks. You may not use them without prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • AllScan AI is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • We do not warrant the accuracy, completeness, or reliability of any identification result.
  • In no event shall AllScan AI, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless AllScan AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changes to features, scan categories, rate limits, pricing, and supported platforms. We will make reasonable efforts to notify users of significant changes, but we are not obligated to maintain any specific feature or service level.

12. Termination

We may restrict or terminate your access to the Service at our sole discretion if we believe you have violated these Terms or are using the Service in a manner that could harm us, other users, or third parties. Upon termination, all rights and licenses granted to you under these Terms will cease immediately.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration body.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AllScan AI regarding your use of the Service. They supersede any prior agreements or understandings, whether written or oral.

16. Changes to These Terms

We reserve the right to update these Terms at any time. When we make changes, we will revise the "Last Updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
